TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern the purchase of motorcycles and use of services provided by Paragon Motorcycles, LLC, doing business as Janus Motorcycles (“Janus Motorcycles,” “we,” “us,” or “our”).

By placing an order, making a payment, or signing an order summary, you (“Customer,” “you”) agree to these Terms.

1. ORDER REVIEW AND CUSTOMER RESPONSIBILITY

You are responsible for reviewing your order in full prior to production.

You agree that the following must be accurate and complete:

Full legal name
Email address
Titling name and address
Model selection
Color, fit, and finish selections
Shipping and mailing address

Failure to verify this information may result in delays, additional costs, or inability to fulfill your order as intended.

2. PAYMENT METHODS

Payments may be made via:

ACH or credit card (credit cards subject to a 3.5% processing fee)
Check, cashier’s check, or money order mailed to:

3. BUILD VERIFICATION

By placing an order or signing your order summary, you certify:

All contact and delivery information is accurate
All model selections, options, and upgrades are correct
You understand your motorcycle is built-to-order

You acknowledge:

Changes after order placement may:
Result in additional fees
Delay production
Be declined if production has progressed

4. DEPOSIT AND PAYMENT POLICY
250 MODELS
A $250 deposit is required to place an order
Deposit becomes non-refundable after 3 business days

Payment schedule:

Day 15: 50% of total invoice due (non-refundable)
Final balance: Due when scheduled for build

Failure to complete payment: 3-day grace period after build completion
If unpaid after grace period: Order is canceled
All payments are forfeited

450 MODELS

A $250 deposit is required
Deposit becomes non-refundable after 3 days

Payment schedule:

Day 25: 50% of total invoice due (non-refundable)
Remaining balance due before delivery or pickup is scheduled

Failure to complete payment:

3-day grace period after build completion
If unpaid after grace period: Order is canceled
All payments are forfeited

5. FINAL SALE POLICY

All motorcycle purchases are:
Final
Non-refundable

Because each motorcycle is built to custom specifications:

No cancellations or refunds are permitted after production begins
Changes after order is processed may result in delays or additional costs

6. PRODUCTION AND DELIVERY

Estimated timelines are provided as guidance only and are not guaranteed.

You acknowledge:

Production timelines may vary due to:
Supply chain delays
Component availability
Customization requirements
Janus Motorcycles is not liable for delays outside its control

7. SHIPPING AND DELIVERY

Shipping arrangements may be handled by Janus Motorcycles or third-party carriers
Risk of loss transfers to the customer upon delivery or pickup
Customer is responsible for:
Providing accurate delivery information
Inspecting the motorcycle upon receipt

Any shipping damage must be reported promptly.

8. TITLING, TAXES, AND REGISTRATION

Customer is responsible for:
Titling
Registration
Applicable taxes (unless otherwise stated)
Requirements vary by state

9. WARRANTY

Janus Motorcycles provides a limited warranty on its motorcycles.

Warranty terms:

Are provided separately
Cover defects in materials and workmanship under normal use
Nontransferable

Warranty does not cover:

Improper use
Modifications
Normal wear and tear

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Janus Motorcycles is not liable for:
Indirect or consequential damages
Loss of use
Loss of profits

Total liability is limited to the amount paid for the motorcycle.

11. ORDER CANCELLATION BY JANUS

We reserve the right to cancel an order if:

Payment obligations are not met
Fraud or misrepresentation is suspected
Production becomes impossible due to external factors

In such cases, refunds (if any) are at our discretion.

12. COMMUNICATIONS AND SMS DISCLOSURE

By providing your phone number and opting in, you consent to receive SMS messages from Janus Motorcycles, including:

Order updates
Customer service communications
Promotional messages (if opted in)

Message and data rates may apply
Reply STOP to opt out
Reply HELP for support

We do not share SMS consent or phone numbers with third parties or affiliates for marketing purposes.

13. PRIVACY

Your use of our Services is also governed by our Privacy Policy.

These Terms are governed by the laws of the State of Indiana.

15. CHANGES TO TERMS

We may update these Terms at any time. Updated versions will be posted on our website with a revised effective date.

16. ACCEPTANCE

By placing an order, making a payment, or signing your order summary, you acknowledge that:

You have read and understood these Terms
You agree to be bound by them

Refunds will be issued on goods that are unused at the request of the customer. If the product is used, we will not issue a refund unless the return is a result of Janus error. Once we receive the returned product and determine that it is still in new condition, we will issue the refund. Exchanges are possible at the request of the customer. Return shipping is paid for by customer.
